Goods
purchased will comply with the Sale of Goods and Supply of Services
Act, 1980 and be of "Satisfactory Quality" unless
specified at the time of sale. Any parts purchased will carry a minimum guarantee of 14 Days.
1. PRIVACY STATEMENT
If you send us correspondence, including emails and
faxes, we may retain such information in the records of your account. We retain
these in order to keep records of our relationship to measure and improve our
customer service, and to investigate potential fraud and violation. We may
overtime, delete these records if permitted by law.
2. PARTS
GUARANTEE
All goods are warranted to be in satisfactory working
order at the time of purchase and checked before been
shipped. In the
event of a fault arising within the guarantee period the seller reserves the
right to either repair or exchange the goods. If replacement goods cannot be
found within a reasonable time then the full purchase price will be refunded.
This will only happen on producing of the original sales invoice and only if
the goods are returned in the same condition as when the goods were supplied. Parts4U
will not hold itself liable to reimburse you for any installation charges no
matter how they are incurred unless otherwise stated. All used vehicle parts
sold are auto salvage, second hand and sold as such. Whilst we wish to give
good value to our customers we cannot guarantee each part to have no cosmetic
marks or other signs of tear & wear as this is reflected in our prices when
they are compared to brand new items.
3. STANDARD WARRANTY
All Used
parts have a minimum of 14 days warranty (unless otherwise stated) and only
part(s) shown on your invoice (receipt) covered by the warranty. This warranty
begins the day the goods collected/delivered. The 14 DAYS WARRANTY will only cover parts
purchased for general/public road use and will be VOID of any WARRANTY if
fitted to any type of Race/Track car or for any other type of off road use. All engines and gearboxes are covered by 30 days warranty (T&Cs
apply). These statements could be superseded by explicitly stated specific
warranty, which would appear in the item's description, in such case only
stated warranty does apply. This warranty is personal to the person named on
the invoice or warranty registration card and may not be transferred to any
other person or company. If any material facts are withheld, false or
fraudulent reports and/or claims are made then this warranty shall become
void. In this event, any payments that have been made by Parts4U will be
repayable forthwith. Under no circumstances Parts4U will entertain any claim(s) whatsoever in
regard to labour costs/charges involved in fitting, removal and or changing of
the parts supplied by the company. This warranty is void if
any part supplied has been tampered with in any way. I.e. seal broken, taken
apart etc. Please note all parts supplied are marked with our company
stamps/initials and digitally recorded, removal of these marks will invalidate
this warranty. No parts may be altered, modified or dismantled in anyway
(except for routine service adjustment) without our permission. Failure to
comply with these terms will invalidate this warranty. This warranty does not
affect your statutory rights.
4. INSPECTION OF
GOODS AND SIGN-OFF OF DELIVERY
All goods
should be inspected upon delivery before signing to ensure that the item has
not been damaged in transit. If goods prove to be damaged, do not sign, refuse
delivery & contact us within two working days. If courier refuses you to
inspect the goods, simply write the word 'Damaged' and then sign. This is to ensure that if necessary, a claim can be made against the
Courier Company. Once the item is in your possession the transaction is then
complete and we cannot claim for ?damage in transit? and therefore cannot offer
a refund on damaged goods from that point on.
5. DELIVERY
Any item
purchased from us must be paid for in full before the item can be released for
delivery or collection. All items are shipped using FASTWAY, UPS or
AN POST. Residents living outside Ireland/UK should contact us before bidding
as postage charges may be higher and we will have to get a quote from our
reputable couriers. Once items are shipped out, the shipping and handling fee
is not refundable. Parts4U will not accept any responsibility for items
'damaged in transit' once they have been delivered and signed for by customers.
All items will be checked and tested prior to packing before leaving Parts4U. If our delivery attempt to you is unsuccessful we will charge for
delivery again which has to be paid in full before we make a second delivery
attempt If the second delivery attempt fails we will not attempt again, so the
item will have to be collected in person (unless otherwise agreed). Please
note any delivery charges incurred are non-refundable. We will do our best to deliver
your parts within two working days of your order within the Ireland & NI
and 3-5 working days to overseas destinations, where this is practical. However,
delays may sometimes occur which are outside of our control. Any date specified
for delivery is therefore approximate only. If delivery is delayed for more
than 21 days, you have the right to contact us and refuse to accept the
products. In these circumstances, we will refund any money paid by you for
those products and delivery charges. However, we will not be responsible for
any other losses, costs, damages or charges that you may suffer if we delay in
supplying or do not supply those products. At the time of delivery you will be
required to validly sign-off on the delivery of the products, after which time
the products become your sole responsibility.
Please note, Bonnets, Doors, Wings, Bumpers and
Glasses are very fragile due to their large thin profile and are therefore
prone to damage. We therefore use specialist couriers to ship these parts to
limited commercial locations within Ireland only. If you wish to be assured of
delivery please confirm this with us when placing your order. For
larger pallet or boxed item(s), you will more than likely be contacted by our
couriers prior to the item being delivered. 'Please ensure a valid and
reachable mobile or landline contact number is supplied along with the payment
on which you are easily reachable'. Delivery of the goods shall be made to the buyer's
nominated address. It is the buyers? responsibility to make all arrangements to
take delivery of goods whenever they are tendered for delivery. When
there is nobody to sign for the item(s) after an arrangement for delivery had
been made between the courier and customer, the courier may attempt a second
delivery at their discretion after which they will return the parcel to their
depot. Customers will be given enough time to collect their item or contact the
couriers but if there is no contact made then the parcel/pallet will be
returned to us at a cost. Courier policy is to attempt to deliver to your
delivery address twice, after which they will put an attempted delivery card
through your post box if nobody was there to sign for the item(s). The
attempted delivery card is not posted for larger items on pallet as customers
are contacted via telephone before delivery is attempted. If there will be
nobody at your delivery address then you may instruct at the time of contact by
couriers to leave with neighbour etc. (Please note this is only at the couriers
discretion if they allow certain parcels to be delivered elsewhere). However,
if you do this and the goods go missing or are damaged it is your
responsibility and there will be no replacement or credit. Unfortunately, we
are unable to deliver to 3rd party Residential Addresses that are not confirmed
on the eBay order details. All deliveries will only be made to the registered
PayPal/Credit Card address and will be made available to us on the eBay order
details page. Every
effort is made to ensure goods arrive at schedule time, no responsibility can
be accepted where any such delay occurs.
6. SHORTAGES OR
DAMAGED GOODS
In the event that a part(s) is supplied and prove to
be incorrect or faulty upon fitting, Parts4U must be notified within 2 working
days upon receipt of the goods in writing. Collection can then be arranged; if
a replacement is not available then a full refund will be offered.
7. CORRECT PARTS
SUPPLIED/ DELIVERED
When a part is supplied correctly by us but you have
made an error whilst ordering that part, Parts4U must be contacted within 2
working days in writing and the part(s) returned to us within 7 days of
purchase for Irish/UK customers and 10 days of purchase for the overseas customers
at the cost of the customer. All refunds made are subject to charging a
handling fee of 20%. Please Note: due to an increase in wrongly ordered items
(i.e. people purchasing items to self-diagnose) we now charge a 20% restocking
fee ? this is to deter this practice, and is an unfortunate condition of sale
that we have had to implement ? postage will not be refunded in any instance. The
deduction made is for time and effort wasted in initial listing of the item,
re-testing, re-listing, re-shelving, & handling the returned part.
8. CLAIMS /
REFUNDS
When you purchase online, you have a statutory right
to return a product (other than perishable produce) within 7 days after your
order has been delivered for replacement (cooling off period). You have a
contractual obligation and we are contracted to you to supply a suitable part
or replacement within 14 days of the initial order. If we are unable to supply
you a replacement product within 14 days then we shall terminate the contract
and refund your money. If a product is damaged or faulty please contact Parts4U
and we will provide a replacement. Refunds will only be given where we are
unable to complete the contract and terminate because no other suitable part is
available. Persons or parties that return goods that are faulty and then do not
allow us 14 days to provide a suitable replacement will be in breach of these
terms and conditions of sale and in breach of contract. All parts are digitally
imaged and the images recorded at Parts4U head office. No refunds will be given
if any part supplied has been tampered with in any way. I.e. seal
broken, taken apart etc. Please note all parts supplied are marked with our
company stamps/initials, removal of these marks will invalidate this warranty.
No parts may be altered, modified or dismantled in anyway (except for routine
service adjustment) without our permission. Failure to comply with these terms
will invalidate the refund option. Note: please see our return policy
9. ELECTRICAL UNITS
All electrical/electronic items must be fitted by a
qualified auto electrician. We cannot accept returns for items damaged as a
result to being incorrectly fitted by unqualified persons. Returns for items
that are not in working order will require written confirmation from a
qualified auto electrician stating problems found. This item is in working
order unless otherwise stated in the description, please see below for our
returns policy should there be any issues. All electrical items such
as "electric motors, control units, sensors, electric injectors etc."
are NON-REFUNDABLE. Please ensure
you ask for the correct part number and you are absolutely certain that the
electrical item you are buying will remedy the problem with your vehicle. Once
an electrical item is ordered and we have confirmed the part numbers you are
unable to return the item for a refund unless our unit proves to be

ENGINES/GEARBOXES WARRANTY
The term
?engine? refers to the cylinder head & block and the components which make
these up (i.e. pistons, cam shafts, con rods, etc.). Any ancillaries left on
the engine including but not limited to the cam belt, water pump, sensors,
water hoses or fuel system are left on free of charge and are not covered by
this warranty (unless otherwise agreed in writing). All engines purchased must be
installed by a qualified and recognised motor mechanic and must be fitted with
a new timing/cam/oil pump belt(s)/chain(s), filled with new oil and filters
upon installation before testing and/or use. Thermostat and temperature
sensor(s) must be changed. Failure to follow this procedure will result in the warranty
being rendered null and void. Proof of Purchase and Professional Installation
will be necessary to proceed with any Warranty claim. Failure to follow these instructions will result in the warranty
been rendered NULL&VOID. We will require a copy of your receipts proving
that you have purchased all the parts listed. We also require a copy of your
mechanics installation receipt showing that those parts where replaced at
installation. NO PAPER WORK MEANS NO WARRANTY. THERE ARE NO EXCEPTIONS. An
Engine service must be carried out by a reputable garage after 500 miles were
the oil and oil filter must be changed (Please note only use the type and grade
of oil recommended by the original engine manufacturer). Manually adjustable
tappets should be checked and reset as required and where applicable the
cooling, fuel and ignition systems as well as auxiliary drive belts should be
checked. Throughout the duration of this warranty the vehicle should be
serviced at least every 7000 miles. Any necessary repairs or maintenance
(whether covered by this Warranty or not) should be carried out as soon as is
practicable and without further detriment to the condition of the engine. All
ancillary parts should always be maintained in good order.
We do not
warranty engine failure or damage occurring directly or indirectly as a result
of the following:
a) Fault
or failure arising from a fitting error or poor workmanship.
b) Fault
or failure of any ancillary components including but not limited to the cooling
system, fuel system, turbo charger/exhaust and ignition system components, etc.
Nor are the ancillaries covered themselves.
c) Where
the vehicle has been used in conjunction with motor sports or marine
situations.
d) As a
result of malicious damage.
e) As a
result of fire or theft or a collision.
f) As a
result of overheating or lack of lubrication (due to insufficient coolant or
lubricant).
The
warranty does not cover gaskets and seals. For instance if an engine?s head
gasket should fail or if the engine is overheated then it will not be covered
under our warranty. The warranty terminates if the engine temperature tabs
(heat tabs) have been tampered with or removed. Any modifications (including
?performance?) or repair work undertaken without the written consent of Parts4U
will invalidate the warranty. Vehicle recovery charges, hire car costs, loss of
earnings, and any other consequential costs which might arise are not covered
by this warranty.
If an
engine needs to be replaced under the terms of this warranty, we require the
faulty engine to be returned to our workshop before we can dispatch a replacement
in order to
conduct a mechanical investigative examination - the purpose of which is to
safeguard both parties to identify any subsequent liability. Engines and
gearboxes must be installed by a qualified mechanic to qualify for the
warranty. Gearboxes must be filled with new oil to the
correct level set by gearbox manufacture upon installation. Failure to follow
this procedure will result in the warranty being rendered NULL&VOID.
The warranty will only cover the parts supplied and
will not cover any labour charges under any circumstances, please bear this in
mind before placing orders.
11. DAMAGED ITEM
(ON SITE)
Occasionally we discover that an item may have been
damaged whilst in storage and as a result the item is unusable so we are unable
to dispatch it. We will initially make contact with the buyer of the occurrence
and will try our best to source a replacement if possible. We reserve the right
to cancel any order and refund the full amount paid by the buyer at any time.
12. SURCHARGES
(Exchange units)
Surcharges must be paid on purchase of all exchange
units. The surcharge will then be credited when the old unit has been returned
has been returned and passed through our returns department.
13. SUITABILITY
OF PARTS
We aim to provide OE part number for any parts we
sell. It is the responsibility of the customer to assure himself that the parts
supplied are suitable and correct for the application involved.
14. GENERAL
We shall not be liable for any failure to perform any
of our obligations under these terms and conditions which is caused by
circumstances beyond our reasonable control, including but not limited to any
force majeure incident. Our failure to exercise any right or provision of the
terms and conditions of sale shall not constitute a waiver of such right or
provision unless acknowledged and agreed to by us in writing. The section
titles in the Terms and Conditions are solely used for the convenience of the
parties and have no legal or contractual significance.
15. LAWS
The Terms of Condition shall be governed by and
construed fully in accordance with the law of Ireland and the United Kingdom. Both
parties agree to submit to the exclusive jurisdiction of the courts located in
the Republic of Ireland. If any provision(s) of the Terms and Conditions is
held by a court of competent jurisdiction to be contrary to law, then such
provision(s) shall be construed, as nearly as possible, to reflect the
intentions of the parties with the other provisions remaining in full force and
effect.
16. CONTRACT
No contract will exist between buyer and Parts4U for a
sale of any product or service unless and until Parts4U accepts your order by
taking payment, confirming your order by email; that it has dispatched your
order. That acceptance will be deemed as complete and to have been effectively
communicated to you at the time. Parts4U sends the email to you (whether or not
you receive the e-mail). All orders for goods shall be deemed to be an offer by
the buyer to purchase goods pursuant to these conditions.
17. WARRANTY
These conditions replace and supersede all previous
issues. These conditions shall apply to all contracts for the sale of goods by
Parts4U to the buyer to the exclusion of all other terms and conditions which
the buyer may purport to apply under any purchase order confirmation or similar
documents. All parts should be examined and tested
before use. We do not accept any responsibility for any problems arising from
any part purchased from us including or due to failure of the part. Any costs
associated with testing, fitting or removal of items bought from us are the
sole responsibility of the purchaser and we will be under no circumstances
responsible for any costs incurred whatsoever. This warranty is void if any
part supplied has been tampered with in any way. I.e. seal broken, taken apart
etc. Please note all parts supplied are marked with our company stamps/initials,
removal of these marks will invalidate this warranty and will void any claim for
reimbursement of costs. No parts may be altered,
modified or dismantled in anyway (except for routine service adjustment)
without our permission. Failure to comply with these terms will invalidate this
warranty. Acceptance
of delivery of the goods shall be deemed conclusive evidence of the Buyers
acceptance of these conditions. The guarantee is applied to the subject sold
and NOT delivery, labour time, car hire, loss of earnings or any other third
party costs. We will always try to supply the exact part that our customers
require. Due to variations in make, model, design and years of manufacture, we
cannot give any guarantee that the parts are correct for the purpose required. Please
be advised, we are parts suppliers and any information we give is advisory,
please refer to a professional (mechanic or auto-electrician) for accurate
information before purchasing parts. Please check the picture, part numbers and
study the description to ensure the part is right for you in order to avoid
items being returned. If you have any queries get in contact with us before

the customer is responsible for making sure the parts bought are correct for
the purpose required. Incorrectly ordered parts shall be subject to a 20%
handling charge. Any part which is found
to be faulty or unserviceable (unless the fault was declared on purchase) will
be repaired or exchanged. If notification is made within 14 days of purchase,
unless the part was sold under special terms evidence in writing and assuming
the part has not been subject to misuse, alterations or substitution. If the
item sold is found to be defective as a direct result of workmanship or
substandard parts etc. Parts4U will rectify the matter in accordance with the
terms of our warranty. Consequently, Parts4U reserves the right to undertake
the initial inspection, thereafter if a dispute arises - or may arise - then
this company - and subsequently our engineer or representative is prevented
from such an examination, then the warranty issued by Parts4U may be
prejudiced. Any variations of these conditions (including any special terms
agreed between the parties) shall be inapplicable unless agreed in writing by
Parts4U. This warranty is non-transferable. All engines and gearboxes are
supplied on an exchange basis, please ensure that the unit is ready for
collection within 14 days of sale or a surcharge will be applied. If an
alternative arrangement has been agreed, please call Parts4U to confirm the
agreement.
18.
CLASSIC CAR/VINTAGE ORDERS
No warranty is given or implied for anything antique
or older than 30 years old due to the nature of metal fatigue age etc. other
than the statutory 7 day cooling off period if sold online.
These
terms and conditions of sale shall replace all previous terms and conditions of
sale of the company and may be subject to change at the Company?s discretion
without prior notification.
