Here is a very unique opportunity to advertise your Twitter name on an Olympian during the 2012 season. I was a member of the 2008 USA Olympic Track and Field Team and am currently ranked #1 in the United States and #6 in the world at 800 meters.  I will wear a temporary tattoo of the Twitter name of the auction winner in every single competition I run in this year, 2012, on my left shoulder (see picture).*

Along with this valuable advertising space (4.7 billion viewers during 2008 Olympic Games), I will tweet a message of support for the auction winner on the first of every month during 2012 from my personal Twitter account, @nsymm800, which currently has over 4500 followers. 

A reserve price is set at $14.95 to cover the cost of having the temporary tattoos made.

*Due to antiquated and crippling rules put in place by the IAAF, I will be forced to cover up the temporary tattoo with tape at all IAAF governed meetings. Thank you to everyone who has checked out this auction and to those of you who have bid on it. In the days since I began this auction I have done interviews with ABC, CBS, Wired.com, The Wall Street Journal, and a host of other media outlets.

Many of these media outlets will be covering the conclusion of this auction. Who's Twitter handle will they be reporting as the winner? It could be yours! 

I did not anticipate this auction gaining so much attention. Due to the fact that this auction is now about an athlete-sponsor relationship that is worth thousands of dollars I feel that it is in both parties best interest to have a contract prepared. From this point forward, by placing a bid on this auction you are agreeing to the terms set forth in the contract below. I believe you will find that these are the same terms as outlined above, but present a bit more clarification as to the terms of the agreement.


That being said, you can rest assured that I will make sure that the person or company who's Twitter name appears on my arm gets much national and international exposure throughout the entire 2012 season. As stated in the contract below, no American has a guaranteed spot on the 2012 Olympic Track and Field Team until after the Olympic Trials. For me to make this team I will need to finish in the top 3 at the USA Olympic Trials. I am the current defending Olympic Trials Champion at 800 meters and in 6 years of competing at the USA National Outdoor Championships my lowest finish has been 2nd.

This contract is made and entered into by and between Nick Symmonds, LLC ("ATHLETE") and _____________ ("SPONSOR"). In consideration of the mutual promises, terms, and conditions set forth below, the parties agree as follows:

Definitions of Terms

(a)  "ATHLETE" means Nicholas Boone Symmonds, Owner of Nick Symmonds, LLC. 

(b)  "NAME" means the Twitter handle of SPONSOR. 
 
(c)  "TATTOO" means a temporary tattoo in the form of a decal or ink impression, not to measure less than two square inches. 

(d)  "SPONSOR" means winning bidder of the E-Bay auction of item #180789582037.

(e)  "PRODUCT" means a single product or service marketed or sold by SPONSOR that SPONSOR designates when entering into this agreement. 

(f)  “TWEET” means an online posting created by a Twitter User.

A. CONTRACT PERIOD: The contract term shall begin upon the execution of this contract and will expire at 12:00 a.m. on January 1, 2013. 

B. ATHLETE'S Responsibilities: ATHLETE agrees to wear a temporary TATTOO of the SPONSOR'S NAME on his left deltoid during all running competitions in the 2012 season, provided that SPONSOR does not sell or market products or services that conflict with ATHLETE’S current sponsors, which include Nike and Melaleuca. The competition include all races on an indoor or outdoor track and road races. The TATTOO shall take the form of decal, henna, or stenciled marker and will be subject to ATHLETE’S discretion so as to maximize the TATTOO’S ability to remain legible during strenuous exercise. ATHLETE also agrees to TWEET the support of the SPONSOR'S NAME on the first of every month during the Contract Period unless specifically prohibited to do so by the rules of the governing bodies under which ATHLETE competes. If SPONSOR is a business or corporation, ATHLETE agrees to endorse the SPONSOR'S designated PRODUCT, provided that the PRODUCT is of a good quality to market to the general public, and provided that the endorsement does not interfere with the terms already set forth in contracts with the ATHLETE’S other sponsors, which include, but are not limited to, NIKE and Melaleuca.  ATHLETE and SPONSOR shall negotiate in good faith fees for advertising and appearances related to ATHLETE’S endorsement of SPONSOR’S PRODUCT, outside of the scope of this contract.

C.  SPONSOR'S Responsibilities: SPONSOR agrees to provide ATHLETE with monetary compensation based on SPONSOR'S winning bid at the E-Bay auction of item #180789582037. This monetary compensation shall be paid as a lump sum payment via check or wire transfer to Nick Symmonds, LLC within ten days of the execution of this contract. SPONSOR also agrees to provide a logo, which will be used to design and produce the TATTOO, and to designate the PRODUCT.

D.  Rules of Governing Bodies: ATHLETE and SPONSOR understand that in some cases, governing bodies including USATF, the IAAF, the USOC, and the IOC may require ATHLETE to cover the TATTOO under their rules, and the Team Member Agreements (TMA). In these instances, ATHLETE will comply with the rules or TMA by covering the logo, and shall remove the covering as soon as the rules or TMA permit. In all interviews before and after a competition, ATHLETE agrees to mention SPONSOR'S NAME when asked about the covering of the TATTOO. 

E.  GUARANTY:  The compensation to ATHLETE under this contract is non-refundable.  ATHLETE and SPONSOR understand that no American athlete has a guaranteed place on the 2012 Olympic Track and Field Team, and that team membership is determined solely based on performance at the 2012 Olympic Trials. ATHLETE and SPONSOR also understand that injuries are an unfortunate part of professional sports.  There shall be no reduction in compensation if ATHLETE is unable to compete due to injury or fails to make the 2012 Olympic Team.  The remaining terms of this contract shall remain in full force and effect.

F.   Exclusivity:   No other form of advertising shall appear on ATHLETE'S left deltoid before, after, or during competition, during the Contract Period.  SPONSOR understands that this is the only form of exclusivity that shall be granted by ATHLETE. 

F.   Contract Territory: The contract territory shall be the World. 

G.  Governing Law:  This contract shall be governed and construed under the law of the State of Oregon.  Any disputes under this contract shall be submitted to binding arbitration under the commercial rules of the American Arbitration Association.  The venue of any arbitration shall be in Eugene, Oregon.
