Manufacturer's guarantee / guarantee conditions

LIMITED WARRANTY STATEMENT

This Limited Warranty applies to the HTC product (the “Product”). HTC warrants that the Product will be free from defects in materials and workmanship at the time of original purchase (“Limited Warranty”).
THIS LIMITED WARRANTY DOES NOT AFFECT ANY STATUTORY RIGHTS.

This Limited Warranty is subject to the following terms and conditions:

1. This Limited Warranty is made to the original purchaser of the product (“Customer”). This Limited Warranty may also be transferred to another person to whom the Product is sold provided that HTC agrees in writing to such sale (HTC will not unreasonably refuse).
The warranty does not exclude or limit the following.
a) Customer's statutory rights or
b) Customer's rights against the seller/dealer of the product.

2. This Limited Warranty is valid for a period of twenty-four (24) months from the date of original purchase for mobile devices and twelve (12) months for accessories (whether such accessories are included with the mobile device or sold separately) excluding media, provided on the Software, CD-ROMs and memory cards (“Warranty Period”).
If Customer makes a claim based on this Limited Warranty, Customer must provide proof of purchase. This Limited Warranty is valid and enforceable only in countries where the Product is sold. However, if you are using the product in a member state of the European
Union, Iceland, Norway, Switzerland, or Turkey, and HTC originally designated the Product for sale in one of those countries, this Limited Warranty is valid and enforceable in all of the countries listed above. If you purchased the product in a country other than those listed above, HTC will attempt to repair the product but does not guarantee the result. Availability of covered services and repair service response time may vary by country and may vary. registration in the country of purchase is required.

3. During the Warranty Period, HTC or an HTC authorized agent will, at its option, repair or replace a defective Product free of charge in accordance with Section 7. Functionally equivalent refurbished units may be used upon repair or replacement. HTC will return the repaired product to the customer or replace it with another functionally equivalent product in good working order. Any replaced defective part or component becomes the property of HTC.

4. This Limited Warranty applies only to the hardware components of the Product as originally shipped. It does not apply to software or other accessories.

5. If HTC repairs or replaces the Product, the repaired or replaced Product will be warranted for the remainder of the warranty period or for three (3) months from the date of repair or replacement, whichever is longer.

6. Before taking any device for repair, back up all important data and remove any confidential, proprietary, or personal information from the product. HTC
assumes no responsibility for damage or loss of programs, data, or removable storage media that you have not backed up.

7. THIS LIMITED WARRANTY WILL NOT APPLY IF:
a) The product serial number, accessory data code, IMEI number, watermark or warranty seal has been removed, erased, defaced, altered or is illegible; or
b) The product has deteriorated due to normal wear and tear; or
c) the product has not been used in accordance with the instructions in the user manual; it was roughly treated; it has been exposed to moisture, moisture or extremes of temperature and other environmental conditions or rapid changes in these conditions; rusting or oxidation occurs; unauthorized modifications or connections have been made; the product has been opened or repaired without permission; Repairs have been made using non-approved spare parts; it has been damaged by accident, acts of nature, or other actions beyond HTC's control (including but not limited to defects in consumable parts), unless the damage can be directly attributed to defects in materials or workmanship. This Limited Warranty does not cover physical damage to the surface of the Product, including but not limited to cracks or scratches on the LCD screen or camera lens; or
d) The errors can be traced back to the battery being short-circuited; the seals of the battery case or cells have been broken; there is clear evidence that the product has been tampered with; the battery has been used in a device for which it is not intended; or
e) The damage can be attributed to a malfunction of the wireless network or another system; or
f) The product software needs to be updated due to changes in wireless network parameters; or
g) the failure may be due to the product being used with or connected to an accessory not approved by HTC; it has been used for purposes for which it is not intended; HTC can prove that the device itself is not at fault.

8. Your product may contain country-specific elements, including software. In case the product was re-exported to another country from the original destination country, the product
contain country-specific items that are not considered a defect under this Limited Warranty.
ANY CLAIM FOR DAMAGES BASED ON THIS WARRANTY MUST NOTIFY HTC OR AN HTC AUTHORIZED REPRESENTATIVE OF THE ALLEGED DAMAGES WITHIN A REASONABLE TIME AFTER THE DAMAGES HAVE BEEN DETERMINED AND BEFORE THE WARRANTY BECOMES INVALID.

9. If there is any damage to the product, the customer should do the following:
a) He should read the user manual to identify the problem and correct it if possible.
b) If the problem cannot be solved with the help of the instructions in this user guide, he should contact the dealer from whom he bought the product. Or he should visit HTC website or HTC service center for more information.
c) Before contacting HTC repair service, he should have the following information ready:

• The model and serial number and the IMEI number of the product.
• His full address and contact information.
• A copy of their original invoice, receipt or proof of purchase of the product.

HTC will then provide the customer with instructions on how and when the defective product should be returned. HTC will bear the cost of sending the defective product to HTC and returning the repaired product to the customer, provided the defect in the product is reported within the warranty period.

10. THIS LIMITED WARRANTY CONSTITUTES THE ENTIRE WARRANTY MADE BY HTC TO THE CUSTOMER. IN NO EVENT SHALL HTC BE LIABLE UNDER THIS WARRANTY FOR LOSS OF PROFITS, LOSS OF SAVINGS ACCEPTED, LOSS OF DATA, LOSS OF PRODUCT OR RELATED EQUIPMENT LOSS, INCIDENTAL OR CONSEQUENTIAL LOSS, OR ANY DAMAGES TO THE EXTENT PERMITTED BY SUCH LOSSES OR DAMAGES MAY BE CLAIMABLE BY LAW. IN ANY CASE, HTC AND ITS SUPPLIERS' LIABILITY UNDER THIS WARRANTY SHALL BE LIMITED TO THE PRICE ACTUALLY PAID BY THE CUSTOMER FOR THE HARDWARE.

HTC does not exclude or limit liability for personal injury or death resulting from its own negligence or for damage to the product resulting from the manufacturer's negligence.

THE LAWS OF SOME COUNTRIES PROVIDE THAT THE MANUFACTURER CANNOT EXCLUDE OR LIMIT ASPECTS OF ITS LIABILITY TO THE CUSTOMER. WHERE THIS IS THE CASE, THE EXCLUSIONS AND LIMITATIONS OF LIABILITY IN THIS LIMITED WARRANTY MAY NOT APPLY.

This warranty gives customers specific legal rights; the customer may also have other rights which may differ from country to country.
This limited warranty does not affect the statutory rights of the customer in the country of purchase. Such rights remain protected. HTC will periodically update this Limited Warranty. Your statutory rights are not restricted by this warranty promise. In particular, any existing statutory warranty rights against us remain unaffected by this guarantee promise.

Information on the battery regulation

Batteries may not be disposed of with household rubbish.
As an end user, you are legally obliged to return used batteries.
You can return batteries after use at the point of sale or in its immediate vicinity
(e.g. in municipal collection points or in retail) free of charge.
You can also return batteries to us by mail.

Batteries or accumulators that contain harmful substances are marked with the symbol of a crossed-out garbage can,
like the symbol below.

The chemical name of the pollutant is located near the garbage can symbol.
"CD" stands for cadmium, "Pb" for = lead and "Hg" for mercury.
