1. Scope, general


1.1 These Terms of Service apply to all sales contracts in which no other individual agreements have been made.

1.2 The specific content and scope of the guarantee services provided by DCMind GmbH can be found in

- these terms of service for warranty services

- the general terms and conditions (GTC) of DCMind GmbH valid when the purchase contract is concluded

1.3 In the event of contradictions between the items listed in section. 1.2 the contractual basis is determined according to the order listed above. In the event of contradictions within a contractual basis, the specifically described version is decisive. A contradiction in the aforementioned sense does not exist if a subordinate contractual basis supplements or specifies a previous one.

1.4 Only the customer as a contractual partner of DCMind GmbH is entitled to claim the guarantee service. DCMind Gmbh assumes no obligations towards third parties, particularly in the event of the server systems being resold by the customer to its customers (end users).

2. Scope of the guarantee services from DCMind GmbH, guarantee period


2.1 DCMind GmbH guarantees the customer in accordance with the following provisions that the products delivered to the customer by DCMind GmbH will be free of material defects within the agreed guarantee period of 3 years.

2.2 The guarantee period of 3 years begins with the provision of the service to the customer. The guarantee can only be claimed by the buyer named in the purchase contract.

2.3 In principle, the guarantee services are agreed between the customer and DCMind GmbH at the same time as the purchase of the products. The guarantee services take place from the day the service is provided (the date of service stated on the invoice from DCMind GmbH is decisive).

2.4 This guarantee extends exclusively to products that were delivered by DCMind GmbH and that are absolutely necessary for system operation. This does not include: panels, housings, hinges, flaps, removable storage devices, manuals, system folders or similar. In addition, all peripheral devices such as keyboards, mice, etc. excluded. Streamers are not covered by the warranty.

2.5 Components subsequently purchased and installed by the customer from third parties are also excluded.

2.6 This guarantee is limited to technical defects in the hardware supplied by DCMind GmbH in the sense of a material defect in accordance with Section 434 of the German Civil Code (BGB). It does not include defects that are due to the fault of the customer, improper handling (such as bent pins on card readers), non-observance of instructions from DCMind GmbH or the manufacturer, deviations from the approved operating conditions (such as continuous operation of not for hard drives released for 24/7 operation) or external interventions (damage by third parties, natural events such as storms, lightning, fire, water, theft, riots, looting, the effects of war or other cases of force majeure). Defects caused by faulty software or incorrect operation of the software by the customer are also expressly excluded.

2.7 Wear-related defects (wearing parts and consumables as well as signs of wear on data carriers), decreasing capacities of accumulators and batteries are excluded from the guarantee, as are defects as a result of attempted repairs by the customer or third parties without the consent of DCMind GmbH. In particular, defects due to reaching the TBW (Total Bites Written) limits specified by the manufacturer are not included. Due to the technology, SSDs are also wear parts and can only be written with data to a limited extent.

3. Content of the service and guarantee services of DCMind GmbH


3.1 DCMind GmbH undertakes to provide the customer with warranty services in accordance with the following provisions. The use of the service requires that the customer contacts the technical support of DCMind GmbH and submits a warranty claim in accordance with Section. 2 asserts.

3.2 With this exchange service, the hardware component identified and reported by the customer as defective will be replaced by sending a replacement component in accordance with the following provisions. DCMind GmbH will send the customer a replacement component as quickly as possible (i.e. within reason and industry standard) by express, which the customer will then replace themselves.

3.3 The replacement will be carried out in accordance with the specifications originally agreed between DCMind GmbH and the customer for a component of equal or higher quality; the brand and model are not relevant. Replacement components can also be repaired parts.

3.4 The customer has no right to exchange complete, executable systems. If functionality can be restored by replacing individual hardware components, the customer's claim is limited to this.

3.5 The use of the guarantee services also requires that the customer reports the guarantee case immediately, at the latest 4 weeks after the first occurrence of the error or defect, to the technical support of DCMind GmbH.

3.6 The exchange service with express shipping as described in section 3.2 can only be provided within the Federal Republic of Germany. Outside the Federal Republic of Germany, delivery takes place via standard shipping.

3.7 DCMind GmbH reserves the right to examine the hardware components reported by the customer as defective and therefore replaced to determine whether there is actually a warranty claim in accordance with Section 2. If the investigation shows that there is no warranty claim according to Section 2, DCMind GmbH expressly reserves the right to charge the customer for the replacement component and shipping costs.

3.8 Other claims by the customer against DCMind GmbH arising from the exchange service agreement are excluded; in particular, DCMind GmbH assumes no liability for damages regardless of fault. The contractual or legal claims of the customer against DCMind GmbH as the seller remain unaffected.

4. Availability of technical support


DCMind GmbH technical support can be reached during DCMind GmbH service hours. These are Monday - Thursday from 8:00 a.m. to 5:30 p.m. and Friday from 8:00 a.m. to 3:00 p.m. If a fault is reported, the serial number of the affected device must be stated. Alternatively, the fault can also be reported to DCMind GmbH support by email. Contact details can be found in the DCMind GmbH imprint.

5. Services not included, data backup

5.1 The exchange service does not include

- backing up and reloading data and applications

- the reconfiguration of RAID systems

- the installation and maintenance of software

- Installing the operating system and application software when hard drives are replaced

5.2 The replacement service also does not include setting security features, deleting passwords, providing and installing BIOS, driver or software updates/upgrades, or restoring software and customer data.

5.3 DCMind GmbH requires the end user to have regular data backups. As part of the replacement service, data, programs, software, etc. located on the defective hardware components may be irretrievably lost. It is therefore the customer's responsibility to ensure that all data, programs, software, etc. are backed up so that a new installation can be carried out after the replacement service has ended. It is also the customer's responsibility to ensure that a functioning infrastructure and the associated recovery processes are available for restoring the backups. As part of the exchange service, individual customer adjustments may also be lost. The restoration or Restoring the customer's individual settings is not part of the exchange service as part of the warranty service. These settings must be made by the customer themselves.

6. Handover of replaced hardware components, data protection


6.1 If hardware components reported as defective are replaced, they become the property of DCMind GmbH.

6.2 The replaced hardware components will be collected by DCMind GmbH at DCMind GmbH’s expense. The customer must ensure that the packaging is safe for transport and that the goods are ready for collection within 10 working days.

6.3 It is the customer's responsibility to ensure that no personal or confidential data is left on the replaced hardware components picked up by DCMind GmbH. DCMind GmbH cannot assume any liability for the preservation or protection of any data that may still exist on these hardware components.

6.4 In the event that replaced hardware components are not made available for collection by DCMind GmbH within 10 working days of delivery of the replacement components, DCMind GmbH is entitled to invoice the customer for the replacement components.

7. Liability


7.1 DCMind GmbH is only liable for damages - regardless of the legal basis - in cases of intent and gross negligence. DCMind GmbH is only liable for simple negligence

- for damages resulting from injury to life, body or health,

- for damages resulting from the breach of an essential contractual obligation (obligation, the fulfillment of which enables the proper execution of the contract in the first place and on whose compliance the contractual partner regularly trusts and may rely); In this case, however, DCMind GmbH's liability is limited to compensation for foreseeable, typically occurring damage.

7.2 These limitations of liability also apply in the event of breaches of duty by or in favor of persons for whose fault DCMind GmbH is responsible according to legal regulations.

7.3 Liability under the Product Liability Act remains unaffected by the liability limitations.

8th. Statute of limitations

All customer claims arising from and in connection with the DCMind GmbH service agreement expire 12 months after the end of the guarantee period.
