TERMS AND CONDITIONS
The following terms and conditions are applicable to the sale of this item. The term "Seller" shall refer to ebay user vertu100M3 and the term "Buyer" to the purchaser of an item from the Seller.
Payment
Please ensure that all payments are made to the Seller within two (2) days of the successful bid in accordance with the specified payment method. Failure to do so may cause an unpaid item case to be opened. Any failure to pay following the time given in relation to the unpaid item case will permit the item to be re-listed without further notice.
Shipping and Packaging
Following successful payment, items will be shipped (in accordance with the shipping method set in the listing) within two (2) working days. All items will be suitably packed. Proof of postage will be obtained by the Seller and thereafter title and risk in the item passes to the Buyer - subject to the returns policy more particularly set out in these terms and conditions.
Condition
All items are in as described condition and as shown in any photographs. No further warranty is given by the Seller.
Returns
In the event that the item shipped and received is either: a) damaged; or b) not in conformance with the description set out in the listing (but not for any other reason), the Buyer must (in order to return the item) notify (by email) the Seller within two (2) days of receipt of the item, clearly setting out the issue with the item together with photographic evidence in support (the "Notice").
Once the Notice is received by the Seller, the Notice will be subject to the Seller's review and response within two (2) days to confirm next steps.
In circumstances in which there is a failure by the Buyer to either: a) serve the Notice on the Seller within the specified period of time; or b) demonstrate to the reasonable satisfaction of the Seller that the item is damaged or is not in conformity with its description set out in the listing, no return will be permitted by the Seller and the matter will be referred to ebay for resolution.
In circumstances in which a return is permitted, please ensure that a proof of postage is obtained (the Seller shall not be liable for any items returned without a proof of postage) and that the item is properly packaged and insured. The cost and expense of returning any item shall be borne solely by the Buyer. Within two (2) days of safe receipt (as notified by the Seller to the Buyer) of any returned item, the Seller shall refund all monies paid by the Buyer at the point of sale.
Any dispute between the Buyer and the Seller not capable of resolution in accordance with the foregoing terms and conditions or the resolution of ebay shall be subject to the laws of England and the exclusive jurisdiction of the courts of England and Wales.
