§ 1 Scope, conclusion of contract

For business relationships with the customer, the following general terms and conditions apply in the version valid at the time of the order when orders are placed via the online auction house eBay.

In the “auction” offer format, the contract is concluded as follows:

If a seller places an item on the eBay website in the “auction” format, he is making a binding offer to conclude a contract for this item. The provider determines a starting price and a deadline (offer duration) within which the offer can be accepted by bid. The bidder accepts the offer by submitting a bid using the bidding function. The bid expires if another bidder submits a higher bid during the offer period. When the auction ends or the offer is terminated prematurely by the provider, a contract for the purchase of the item is concluded between the provider and the highest bidder, unless the provider was legally entitled to withdraw the offer and delete the existing bids. After a legitimate bid withdrawal, no contract is concluded between the member who is the highest bidder again after the auction has ended due to the bid withdrawal and the provider. The provider and the highest bidder can agree that a contract is concluded.

Each bidder can submit a maximum bid at an auction. The maximum bid represents the maximum amount the bidder is willing to pay for the item. The maximum bid remains hidden from the seller and other bidders. If other members bid on the item, the current bid is automatically increased step by step so that the bidder remains the highest bidder until his maximum bid has been exceeded by another member.

Under certain conditions, providers can set a minimum price for an auction that differs from the starting price. In this case, a contract will not be concluded if the highest bidder's bid does not reach the minimum price at the end of the auction.

Under certain conditions, offers can also be provided with the Buy Now option (fixed price). In this case, a contract for the purchase of the item is concluded at the buy-it-now price (fixed price), regardless of the end of the offer period and without conducting an auction, if a member exercises this option. The option can be exercised by any member as long as no bid has been placed on the item or the bids have not yet reached a minimum price set by the provider.
In the “Buy It Now” offer format, the contract is concluded as follows:
If a provider lists an item in the Buy It Now offer format, he is making a binding offer that other members can purchase the item at the specified price. The contract is concluded when a member clicks the “Buy Now” button and confirms the process.
With the “Buy now” offer format in conjunction with the “Suggest price” option, the contract is concluded as follows:
In certain categories, the provider can add the “Suggest price” option to his offer. Interested parties can make the provider an offer to purchase the item at a certain price. The provider can accept a price proposal, reject it or make a counterproposal. Price suggestions from interested parties and counter-suggestions from the provider are binding and remain valid for 48 hours. A contract is concluded when the provider and the interested party agree on the price, be it via the “Suggest Price” function or at the original Buy It Now price. With conclusion of the contract all price proposals and counterproposals are no longer valid.

 

If the customer is a consumer, we bear the shipping risk in any case, regardless of the shipping method. If the customer is an entrepreneur, all risks and dangers of shipping are transferred to the customer as soon as the goods have been handed over by us to the appointed logistics partner.

 

§ 3 Bearing the regular costs of returns in the event that the right of withdrawal is exercised
