This is a NEW PHONE.

I did open and played with it for a few days but basically new. 

On the box it lists as compatible with WITH BOTH CDMA and GSM but I tried a non-T Mobile sim and it wouldn't register.

Will work with T Mobile, but can definitely be unlocked as it's listed.
