YOU AGREE TO THE FOLLOWING AS WELL: WE
UNDERSTAND YOU MAY DESIRE TO HAVE OUR PROPERTY EVALUATED. IN SUCH
CIRCUMSTANCES, IF YOU DESIRE TO HAVE OUR PROPERTY EVALUATED, YOU AGREE TO USING
A REPUTABLE MERCHANT THAT USES ONLY NON-DESTRUCTIVE ELECTRONIC MEANS WIDELY
RECOGNIZED AND ACCEPTED IN THE INDUSTRY AS RELIABLE. ANY EVALUATION THAT IS
DETERMINED TO MATERIALLY CONTRADICT OUR DESCRIPTION MUST BE PROVIDED IN WRITING
ON COMPANY LETTERHEAD FROM THE MERCHANT PROVIDING THE EVALUATION IF YOU ARE
ASKING FOR A REFUND BECAUSE THE MERCHANDISE EVALUATED WAS DETERMINED TO BE
"NOT AS DESCRIBED":
A MERCHANT UNDER THE UCC IS DEFINED
AS: [A] person is a "merchant" if he (1) deals in goods of
the kind, or (2) by his occupation holds himself out as having knowledge or
skill peculiar to the practices involved in the transaction, or (3) by his
occupation holds himself out as having knowledge or skill peculiar to the goods
involved in the transaction, or (4) employs an intermediary who by his
occupation holds himself out as having such knowledge or skill, and that
knowledge or skill may be attributed to the person whose status is in question.
MATERIALITY IS AN OBJECTIVELY DETERMINABLE FACT
THAT IS UNDERSTOOD TO MEAN SOEMTHING POLAR OPPOSITE OF OUR AUCTION DESCRIPTION,
AND NOT SOMETHING THAT IS SUBJECTIVE SUCH AS PRICE. FOR EXAMPLE, WHEN WE
DESCRIBE AN ITEM TO BE "SOLID 14K GOLD", AND A MERCHANTS EVALUATION
DETERMINES THE ITEM TO BE 14K GOLD PLATED, THAT IS A MATERIALLY SIGNIFICANT
FACT.
YOUR FAILURE, AND OR WILLFUL REFUSASL TO PROVIDE
SAID DOCUMENTATION IS A BREACH OF THIS AGREEMENT AND NO REFUND WILL BE PROVIDED
ALL FRAUD CASES ARE REPORTED TO LAW ENFORCEMENT
