eBay Agreement of Fair Buying and Selling

Non-Negotiable "Buyer Requirements"

All eBay Buyers and Sellers should want every transaction to proceed smoothly, efficiently and be successful for all parties involved!

The "Four Primary Factors" in having such a mutually successful transaction are:

(1) The Seller writing accurate descriptions and providing clear photographs of the merchandise for sale, and specifying conditions and procedures for processing the transaction;

(2) The Potential Buyer carefully:

(a) Reading the entire eBay listing, and

(b) Examining all of the photographs;

(3) The Potential Buyer communicating with the Seller, through eBay Messaging, about:

(a) Any part of the listing that is any way unclear, incomplete or which they find confusing or may need clarification; and

(b) Thereafter waiting and allowing the Seller a reasonable 72 hours to respond to Potential Buyer's question(s).

(4) The Presumed Buyer, after merchandise delivery:

(a) Immediately informing the Seller, through eBay Messaging, about any and all problems or "Buyer Dissatisfactions" with the merchandise and transaction; and

(b) Thereafter waiting and allowing the Seller a reasonable 72 hours to respond to each Presumed Buyer communication, and thereby help to resolve the "Buyer's Dissatisfactions."

These "Four Primary Factors" (#1, #2, #3 and #4) are so important that the "eBay User Agreement" makes most of them MANDATORY REQUIREMENTS for both Buyers and Sellers! Therefore:

(A) Abiding by "eBay User Agreement". Seller will NOT knowingly engage in any transaction with any Potential Buyer who has not read and agreed in good faith, prior to initiating a transaction, to all terms and conditions incorporated into the "eBay User Agreement."

(Presumed Buyer agrees, for consideration of Seller initiating processing of transaction, that failure to conduct themselves in full conformance with every part of the "eBay User Agreement" is prima facie proof that the Potential Buyer never honestly agreed to all terms and conditions of that Agreement prior to the transaction.)

(B) Communicating Buyer's Questions and "Dissatisfactions". Seller will NOT knowingly engage in any transaction with any Potential Buyer who does not promise and agree, prior to initiating a transaction, to conduct themselves in conformance with the "Four Primary Factors."

(Presumed Buyer agrees, for consideration of Seller initiating processing of transaction, that failure to conduct themselves in full conformance with the "Four Primary Factors" is prima facie proof that Potential Buyer never made the required pre-transaction promise.)

(C) Answering Seller's Questions. Seller will NOT knowingly engage in any transacting with any Potential Buyer who does not promise and agree, prior to initiating a transaction, to assist Seller in resolving all problems and "Buyer Dissatisfaction(s)" by answering and providing, within 72 hours of request(s), each and all of Seller's questions and requests for images.

(Presumed Buyer agrees, for consideration of Seller initiating processing of transaction, that any failure to timely so answer Seller's questions and provide images is prima facie proof that the Potential Buyer never made the required pre-transaction promise.)

In addition, Seller has observed, over many years of sales and thousands of buyers, apparent patterns and statistical correlations between Buyer behaviors and Buyer Abuse and Misconduct involving transactions and the eBay Buyer Protection Program. Therefore:

(D) Reporting Missing Shipments. Seller will NOT knowingly engage in any transacting with any Potential Buyer who does not promise and agree, prior to initiating a transaction, to immediately contact Seller through eBay Messaging, in no case later than 23 days after a purchase and non-delivery of merchandise, to notify Seller of Buyer's knowledge or any suspicions of missing, overdue or non-delivery of merchandise.

(Presumed Buyer agrees, for consideration of Seller initiating processing of transaction, that failure to provide said notice, within the maximum allowed period, is prima facie proof that the Potential Buyer never made the required pre-transaction promise.)

(E) Reporting Shipment-Damaged Merchandise. Seller will NOT knowingly engage in any transacting with any Potential Buyer who does not promise and agree, prior to initiating a transaction, to contact Seller through eBay Messaging, within 48 hours of merchandise delivery, to (i) provide an inventory and descriptions of all missing or externally-damaged components of merchandise and packaging, and (ii) confirm safe delivery of all other merchandise and packaging materials.

(Presumed Buyer agrees, for consideration of Seller initiating processing of transaction, that any failure to timely provide all such information is prima facie proof that the Potential Buyer never made the required pre-transaction promise.)

BY INITIATING A PURCHASE FROM SELLER'S EBAY LISTING, THE POTENTIAL BUYER REPRESENTS THAT THEY FULLY MEET SELLER'S "BUYER REQUIREMENTS," AND WILL CONDUCT THEMSELVES IN COMPLETE CONFORMANCE WITH THE SELLER'S "BUYER REQUIREMENTS" AND THE "EBAY USER AGREEMENT."

IF THE POTENTIAL BUYER DOES NOT FULLY AGREE WITH SELLER'S "BUYER REQUIREMENTS," THEN THE POTENTIAL BUYER IS FORBIDDEN BY SELLER AND THE "EBAY USER AGREEMENT" FROM INITIATING ANY PURCHASE FROM SELLER!

IF THE POTENTIAL BUYER HAS PREVIOUSLY BEEN ASKED BY SELLER TO NOT PURCHASE SELLER'S OR ANY "ASSOCIATED COMPANIES'" PRODUCTS, THEN THE POTENTIAL BUYER IS FORBIDDEN BY SELLER AND THE "EBAY USER AGREEMENT" FROM INITIATING ANY PURCHASE FROM SELLER!

A POTENTIAL BUYER OR PRESUMPTIVE BUYER THAT DOES NOT PROMISE AND AGREE OR DOES NOT FULLY CONFORM TO ALL OF THE SELLER'S "BUYER REQUIREMENTS," THE "EBAY USER AGREEMENT," AND ANY ADDITIONAL FULLY NEGOTIABLE "TERMS OF SALE" POSTED IN THE LISTING (INCORPORATED INTO THESE "BUYER REQUIREMENTS" BY REFERENCE), IS AN "UNWELCOME AND MALICIOUS BUYER."

PURSUANT TO CALIFORNIA LAW AND THE "EBAY USER AGREEMENT," ANY ATTEMPTED OR PRESUMED PURCHASE BY AN "UNWELCOME AND MALICIOUS BUYER" IS VOID OR RESCINDABLE. PURSUANT TO CALIFORNIA LAW AND THE "EBAY USER AGREEMENT," SELLER HEREBY ELECTS AND DECLARES THAT ANY AND ALL SUCH VOID OR RESCINDABLE TRANSACTIONS, INCLUDING ALL DERIVATIVE "EBAY RIGHTS AND PRIVILEGES" THAT WOULD OTHERWISE ARISE FROM A VALID TRANSACTION, ARE IMMEDIATELY AND AUTOMATICALLY RESCINDED FOR "LACK OF MUTUAL AGREEMENT" AND "FRAUD."

NON-WAIVER OF RIGHTS. Presumed Buyer agrees, for consideration of Seller initiating processing of transaction, that: (i) Failure of Seller to promptly or ever identify an "Unwanted and Malicious Buyer," or ever recognize a void or an automatically rescinded transaction, or ever enforce rights derived therefrom, is not a waiver of any rights, past, present or future; (ii) Seller's failure to immediately act with respect to any Breach by Presumed Buyer does not waive Seller's right to act upon that Breach at a later time, or with respect to other Breaches; and (iii) Seller does not guarantee that Seller will take immediate, or any, action against all Breaches associated with these Buyer Requirements.
