General
12 Month Warranty Your satisfaction is our goal, and we stand behind all the products that we sell. This part is warrantied for a period of 12 months from the purchase date, (view Terms and Conditions). This warranty does not cover installation labour or any additional expenses that may result from a defective product. Please make sure that the part you ordered is the correct part and fits your vehicle before cutting, painting, altering or final installation. Altered items and custom orders are not refundable or returnable. Please inspect the parts immediately after receiving your order. The warranty does not cover failure due to abuse, misuse, improper repairs or maintenance, installation, alteration, or modifications. The warranty does not cover normal wear and tear, and consequential or subsequent damages. If a replacement is not available, a full refund for the cost of the part and original shipping paid will be issued. Invoice TermsBlack Diamond Auto Dismantles offer a minimum 6 and 12 Month Warranty for all used and second hand parts (unless otherwise stated). These warranty terms are not transferable and original invoices are required for proof of purchase. No Labor Warranty. All parts must be installed within 30 days of delivery or pick up in accordance with procedures set forth within this document. All warranty claims must be validated with original receipts of purchase. At Black Diamond Auto Dismantler’s discretion, we will repair, replace, or refund any defective part to the original purchaser, providing all warranty guidelines & procedures have been followed. Exclusions: 1. Parts installed in vehicles for off road use, or street legal vehicles modified beyond factory specifications are not covered by this warranty. 2. Parts installed in commercial, or fleet vehicles or marine use are not covered by this warranty. 3. Incidental or consequential damages including but not limited to the cost of related parts, loss of income, travel expenses, rental, towing, and diagnostics fees are not covered by this warranty. 4. This warranty will not cover damages or failure arising directly or indirectly due to improper installation or related vehicle issues, misuse, abuse, maintenance neglect, environmental conditions, or accidents. General Limitations: 1. Black Diamond Auto Dismantles reserves the right to have the part inspected to ensure that all the provisions stated within the warranty have been met and to inspect the part prior to repair, replacement or refund. 2. Any repairs or removal of the part before Black Diamond Auto Dismantles or its contractor can inspect the part will void the warranty. 3. Warranty is valid to original purchaser only. Warranty is not transferable. Any part returned must be in same condition as when purchased. 4. This part may have accessories that are attached and must be removed or switched for proper installation. This is solely the responsibility of the installer as such accessories are not covered under this warranty. 5. Warranties are applicable on the part supplied, products repaired or replaced under warranty for which a warranty claim has been recognised by Black Diamond Auto Dismantles (regardless of the type of warranty claim made) shall thereafter be covered only for the balance of the original warranty period. 6. This warranty is void if any of the following occurs: (A) Part is installed in an application not intended by the vehicle manufacturer. (B) Failure caused by towing a trailer unless your vehicle is rated by the manufacturer for towing. (C) Failures caused by non-covered components, improper installation, abuse, misuse, racing, poor workmanship, improper or lack of maintenance. (D) Failure caused by or related to collisions, theft, vandalism or any act of God. (E) Warranty on all mechanical parts including but not limited to Engines and Transmissions is void unless installed by a qualified technician. Engines: This warranty is limited to defects of the engine block, heads, valves, rockers, lifters, pistons, crank and cam shafts and other internal lubricated parts. All external parts left on engines are not covered under this warranty such as sensors, gas or diesel injectors, throttle body, timing belts, gaskets, seals, exhaust or intake manifolds, water pump, coil packs or any part not internally lubricated. Engine installations follow the procedures: Replace the following parts if applicable: timing belt, water pump, thermostat, spark plugs, fluids, oil pan gasket, oil and oil filter. Warranty is contingent upon oil and filter change (per manufacturer’s specifications as to type) at installation and every 5,000 kilometres thereafter. The customer must provide proof of service or warranty is voided. Overheating and/or improper installation voids all warranties. Engine warranty is contingent upon installation of new intake manifold gaskets. Transmissions: Replace the following with new parts: front pump and output shaft seals, pan gaskets and filter. Flush or replace transmission cooler and lines. Adjust shifter and kickdown cables and linkage if applicable. Clear all computer fault codes. Manual transmissions follow the same procedure as above if applicable. All the above installation should be in accordance with manufacturer guidelines including proper quantity and fill levels of fluids and any technical service bulletins and updates. Warranty covers slippage, shifting failures and/or bearing noise. Shearing or breaking of teeth in a standard transmission is not warranted under any circumstances. On automatic transmissions with overdrive, warranty is void if transmission is not adjusted by a certified technician prior to driving. Improper installation voids all warranties. Customer must provide proof of service or warranty is voided. Exchange/Credit Policy In the instance that you are dissatisfied with the quality, condition or operation of the part you have purchased from Black Diamond Auto Dismantlers please return it for an exchange. In cases where we do not have a replacement part we will locate & order one in for you. If we are unable to do so, you will receive a refund. All exchanges / credits or refunds must be accompanied by a Tax Invoice as proof of purchase. Credit may incur a 15% handling fee at managements discretion. Your Refund Rights You are entitled to a refund if the goods purchased. (A) are defective (the defect not being caused by you), or . (B) do not match the description or sample provided by us, or (C) do not do what they are supposed to or what we said they would (D) In these instances above, we will be responsible for return freight costs, should we require the item to be returned. You are still entitled to a refund if you change your mind or make a wrong choice, however a 15% handling fee may be charged & you will be responsible for any return freight costs. Returns Terms & ConditionsRETURNS POLICY GENERAL: 1. Black Diamond Parts Plus Pty Ltd offers replacements, repairs and refunds in accordance with Australian Consumer Law and on the terms set out in our Warranty Policy and in this Returns Policy. 2. Any benefits set out in this Policy may apply in addition to consumer rights under Australia Consumer Law. 3. Before making a purchase please read these policies so that you understand your rights and what you can expect from us. Australian Consumer Law 1. Our goods and services come with guarantees that cannot be excluded under Australian Consumer Law. 2. We offer repairs, replacement or refund in accordance with Australian Consumer Law. If you need to return an item, please open the return, and select the reason "I changed my mind". Once that is done a return label will be issued. Cancellation and Change of Mind 1. In the event that you receive the products you have purchased but that you simply change your mind or decide you no longer require the goods, we may, at our discretion, offer you a refund or exchange provided that: (A) You notify us within 7 Days of receipt. (B) The goods are NOT electrical or electronic components. (C) The goods were not specially procured for you. (D) You meet all freight costs involved in the supply and return of the goods. Goods Damaged in Transit 1. In the event that that the goods you ordered were damaged during delivery: (A) Please contact us as soon as possible. (B) Any damaged product must be returned as soon as possible including the packaging. 2. You must contact us immediately you become aware of any fault in goods supplied by us. Please quote you invoice number. 3. The period of the warranty is from the date of invoice. Our basic warranty is a 6 / 12 Months parts only guarantee – labour costs will not be met. Other warranty periods may apply. 4. The decision to repair OR to replace a faulty part is at our discretion. Exceptions 1. Notwithstanding the other provisions of this policy we may refuse to provide a repair, replacement or refund for goods if: (A) You misused the said goods in a way that caused the problem. (B) The goods were not in fact faulty when that was given as the reason for their return. (C) You knew or were made aware of the problem(s) with the said goods before we supplied them. (D) Any other exceptions applicable under Australian Consumer Law. Shipping Costs for Returns: 1. In the event the goods you have purchased fail to meet one or more of the consumer guarantees we will meet the cost of shipping, but only after prior consultation. 2. For goods returned as per clause “Cancellation or Change of Mind” you, the purchaser, MUST meet shipping costs. 3. In the event that we organise and pay the costs of returning goods that then prove not to be eligible under this Returns Policy (see Exceptions above) you will then be required to pay these costs and will be invoiced accordingly. How to Return Products 1. Use the contact details on the invoice to discuss the return, replacement or repair of a product. 2. Any refunds made will be made in the same form as the original purchase or to the same account or using the same credit card. 3. You must provide proof of purchase. Shipping Terms & ConditionsFor all deliveries and shipments, a street address (not a PO Box number) is required. For all freight quotes, please supply us with a destination suburb & postcode. All large items including such as engines, will need a business delivery address that have facilities (eg. forklift) to unload the item or an $88 charge for a tailgate lift truck will be charged. Alternatively, collection from the freight depot is suggested. For larger items such as engines and transmissions our freight carrier requires a commercial business address with a loading dock or forklift to unload the truck. Most of our customers choose to ship directly to the shop that is installing their part as long as it is a commercial business address. If you cannot provide a commercial business address, we can deliver this part to a freight terminal for your pick-up at no additional charge.
