*Buyers acknowledges having read and understood the details herein, pursuant to the terms and provisions of this listing above aforementioned, and hereby does agree to proceed in accordance therein with the purchase of said item. Buyer furthermore fully understands and agrees that any and all listing detail provisions and stipulations, herein, shall  completely supersede any and all Ebay disclaimers, stipulations, provisions and representations in their entirety related to this listing.  

*Sales tax: Sales tax is implemented by Ebay. NOT the seller. Seller does not charge buyers tax, Ebay is the entity responsible for any and all sales tax charges to buyers. If there are any concerns and or questions regarding this charge , please direct all correspondence to Ebay administration department. 

*Domestic shipping: All domestic shipping, seller reserves the right to choose carrier; USPS, UPS, FED-X, for domestic purchases. In the event there are any related tax, sales or otherwise, federal or state imposed, then buyer to pay. Buyer to investigate and determine same. 

*Shipping Time: Seller will ship item within 5 calendar days (not counting Holidays, Weekends or Payment Day) of payment being received. If for any reason whatsoever the item is undelivered or delivery is declined, then buyer shall incur any/all costs associated with, but not limited to; shipping, insurance, handling, Ebay fees, PayPal fees or any other charge, cost, expenditure or fee related to this transaction, including return shipping. In the event the item is uninsurable or insurance cannot be obtained through Ebay (UPS or USPS) then in that event buyer herein agrees to accept any and all responsibility and assume any and all liability, risk and costs with having the item shipped, delivered and received. In addition, if an item is refused by buyer, or non deliverable due to the buyer address, location, and/or any  other buyer related circumstance, then in that event buyer herein agrees to pay any and all costs, for any and all shipping/delivery costs in it's entirety (delivery, returns or otherwise, as a result of this transaction).

*Returns: In the event seller accepts returns, then buyer and seller herein agree to the following, which shall furthermore supersede any other Ebay provision specified in the listing therein, and/or Ebay return policy of "money back" guarantees. In the event buyer returns item, buyer has 7  calendar days after receipt of item to return ship item in the exact same condition as seller shipped, with all packaging and related material in its entirety. Buyer pays all return shipping costs, and all  additional related costs, disclosed herein, and must include insurance and tracking for the amount of item purchased.

*Item "not as described": In the event the buyer initiates a return based on their assumption that the item is not as described, than in that event the buyer must make contact with seller within 7 calendar days after confirmation/receipt of delivery otherwise the alleged claim is rendered void and expired. The provisions in the "Returns" subcategory, above herein, shall apply in the event the seller accepts this return. In addition, buyer is to expressly provide seller with specific  particularized itemized, minute proportionate details of said claim when testifying of such allegation. This statement must be prepared and signed by buyer and disseminated to seller and Ebay Administration Department, at which point the alleged claim shall be evaluated, examined and assessed to render a judgement. A "not as described" item MUST be in a state of being "substantially altered" from the description given in the listing, that being objectively different than that which was visually portrayed and was reasonably described.  In many cases buyers who subsequently have buyers remorse fabricate unreasonable and unjustifiable claims as to an item's condition in order to avoid paying any shipping costs associated with their purchase. These claims are unacceptable, illegal, and in violation of Ebay policy and will not be tolerated or allowed. Furthermore, any and all damages therein incurred by seller for such claims shall be paid for in full by buyer.            

*Shipping costs: In the event the item was listed with "free shipping", the free shipping ONLY applies to the initial sale of the item, i.e., if the buyer keeps the item. If in the event the item is returned, buyer will then reimburse seller for any and all initial shipping fees and related costs paid by seller, whether or not shipping was "listed" as free ship in listing. There is a restocking fee of 15% of purchase price, no exceptions; seller reserves the right to waive said fees at sellers discretion.
