These are our purchase terms, please read before bidding, Buy It Now or Best Offers: 

Per eBay Rules & Regulations and per all state, federal and international law, by bidding on or purchasing our listing you are entering into a legally binding contract.  If you do not intend to honor the terms and conditions, do not bid/purchase from our listings.  If you do decide to bid on/purchase from our listings but do not intend to honor the terms of purchase, by law you are committing willful fraud.

1.   PAYMENT: US funds via: PayPal (www.paypal.com). International payments via PayPal ONLY.  PROMPT payment is expected after closing of any purchase, unless we have agreed in advance to other arrangements (typically 3 days via PayPal).  
   
2.   SHIPPING: This sale is for an item that can only be picked up locally or SHIPPED BY FREIGHT; and as such is SOLD AS IS WHERE IS. Buyer is responsible for all arrangements for pick up and shipment of the item unless arrangements have been made with A Phoenix Rises...PRIOR TO BIDDING, BUY IT NOW, OR BEST OFFER.

3.   COMMUNICATION: BUYER is expected to make contact within 3 days of the listing’s close. We will normally e-mail or invoice the winning bidder within 24 hours of the listing’s close to work out payment and shipping arrangements.

4.   BLOCKED/CANCELLED BIDS: We reserve the right to refuse/cancel sale/s or to cancel/block bids from buyers with zero or negative feedback; or for any reason we deem appropriate to us..

5.   WARRANTY: Due to the nature of the items we sell, all items are sold "as-is" without any warranty implied, expected or otherwise.  We make every effort to detail the condition and/or all damage between descriptions and photographs.  Please see our definitions regarding condition below…regardless of anyone else’s definitions of these words; by purchasing our listings you are agreeing to these definitions.  Please be sure to ask questions before bidding on items.  All our items are invisibly security marked.

6.   QUESTIONS: The buyer’s failure to read and understand the written descriptions does not constitute an error on our part. It is the buyer’s responsibility to ask questions (and definitions of terminology if necessary) before they buy.

7.  ELECTRONICS:  All items were in working order when acquired and listed.  As far as we know the items are STILL in working order when shipped. Due to limited testing facilities, and lack of spare parts for wiring, etc., handling by the carriers we are unable to guarantee that items will be received in working order. We pack more than well enough to get them to you safely and still working, but we will not be responsible for anything after it is out of our hands/shipped. That is at the buyer’s own risk.

8.  NON-PAYMENT:  Unpaid/Late Paid items are subject to interest accrual at the highest rate allowed by law in our state, and collection/legal action independent of eBay.

9.  LIQUIDATED DAMAGES: Payment made after the timing noted in the above Terms & Conditions, may, at the our option, become Liquidated Damages/"compensation to seller" for time loss of an item being removed from listing during a period it may have sold to another buyer at the same or a higher price.

       Time is of the essence. Buyer is responsible to have payment to seller in the time specified above; unless other arrangements have been made with seller in writing, usually in advance of bidding/buying. Once seller determines that a late payment has been converted to Liquidated Damages, buyer relinquishes/waives all recourse against the seller, eBay and/or PayPal and or any other payment method involved and relinquishes all claim to the item involved.

10. RETURNS: All sales are final. However in the event of any return for any reason there will be a 30% restocking fee and there will NEVER be a shipping handling refund of any kind for such situation.

11. By bidding on any item, you indicate your full agreement to all the above terms and release us from further responsibility/liability.

As with all descriptions, they are subjective to the educated/experienced opinions of the person making the description. These are the generally accepted definitions, by most all appraisers (got them from our appraiser…hence we use them).

            As it came from the manufacturer; including any manufacturing flaws/defects. If you are concerned about manufacturing flaws or defects, it is your responsibility to ask about them.

           Can also mean it is old unsold back stock that has never been sold retail before. This can include some very old items!

EXCELLENT...DOES NOT mean New, Perfect, Mint NOR Flawless.
