Brand new and sealed but long retired. This is the first generation magnet. The magnet is in the 2x4 brick base, not in the minifigure. The minifigures detach from the base and are standard minifgs. I don't think the torso and legs are glued together but I wouldn't swear to it. One of the many things my kids didn't get into.
