An indentured assignment document relating to property in Cartworth, Kirkburton, Yorkshire, which forms part of a marriage settlement. The document is dated 28 May 1747, during the reign of George the second.

The agreement is between Martha Pears of the parish of Thornhill in the county of York, widow of the one part, and James Shaw of Wardplace in Cartworth, within the parish of Kirkburton and the county of York, clothier of the other part.

The consideration given for the agreement is that of natural love and affection, which she the said Martha Pears has and bears unto the said, James Shaw. This indicates that this property agreement was part of a marriage agreement.

The property referred to is a close of land of arable meadow and pasture, one called the Marsh and the other called Intaik, containing by estimation, 1 acre and a half of land on a parcel of land lying on the north part of the aforesaid close called Intaik the same as (…) with all the ways, passages, Waters, watercourses, liberties, easements, commons whatsoever to the said close belonging, or appertaining and occupied or enjoyed with all, and singular their appurtenances in Cartworth within the township of Holme and now in the tenure or occupation, possession of Richard Littlewood or his assigns.

The mark and seal of Martha Pears is found in the bottom margin of the document, and the left margin contains a duty stamp for a total of 18p.

The back of the document indicates that it was registered at Wakefield, on the 7th of September 1750.

The document appears to be on vellum. The document is in reasonable condition for its age with obvious fold lines, and browning. Wear in the fold lines, particularly where they meet. No tears. Please see photos.
