All claims pertaining to damage from shipment must be asserted in writing within ten (10) days after delivery of such Product or such claims are waived in perpetuity. Any lawsuit by Buyer based upon breach of this contract or upon any other claim arising out of this sale must be commenced within thirty (30) days from the tender of delivery by Everything4sale-10.
- LIABILITY: IN NO EVENT SHALL EVERYTHING4SALE-10 BE LIABLE TO BUYER FOR ANY SPECIAL, INDIRECT, INCIDENTAL OR CONSEQUENTIAL DAMAGES ARISING OUT OF OR AS THE RESULT OF THE SALE, DELIVERY, NON-DELIVERY, INSTALLATION, SERVICING, USE OR LOSS OF USE OF THE PRODUCTS OR ANY PART THEREOF, OR FOR ANY CHARGES OR EXPENSES OF ANY NATURE INCURRED WITHOUT EVERYTHING4SALE-10'S WRITTEN CONSENT, EVEN THOUGH EVERYTHING4SAL-10 HAS BEEN NEGLIGENT. - CANCELLATION: Return request must be preapproved. Orders canceled prior to shipment are subject to a 10% restocking fee per day that the listing has been removed from active listings. Order cancellation request that have been approved after shipment is subject to a 50% restocking fee and refund will be less shipping cost to and from the Buyer. A 75% restocking fee will be charged for all unapproved returns and shipping cost to and from the Buyer will not be reimbursed. Items must be returned in original condition, not damaged, tampered with or altered. Once the product has been received in its original condition a refund will be issued in the original form of payment. If you would like to order a different item you may use your credit toward the new order but will still be charged shipping. No returns on international sales (excluding Canada)
