This card appears to be new. I can detect no signs of mounting (around dvi adapter, on bracket, etc.), and there is no dust built up on the fan, heatsink, etc..
I will gladly refund money and shipping for a non-functional card, if for some reason it arrives doa, but I am confident this card is working perfectly. No returns for mistakes in fit or compatibility, so please be sure this works for you before buying.
