New and factory sealed, though there is a tear to the shrinkwrap (circled in last photo), some 'scratch' type marks to the back of the shrinkwrap (2nd photo), and a small hole in the shrinkwrap on the spine (circled in 3rd photo).  I probably wouldn't recommend it for sealed collectors but would be fine for someone just looking for a new copy if you're planning to open it.
