2. Conclusion of contract, contract text, prices, codes of conduct

a) The conclusion of the contract is based on Section 6 of the General Terms and Conditions of the Internet platform eBay, which provides for the following variants of contract conclusion:

cc) Fixed price items “Buy it now”

For fixed-price items, the buyer accepts the offer by clicking the “Buy Now” button and then confirming it. For fixed-price items for which the seller has selected the “Immediate payment” option, the buyer accepts the offer by clicking the “Buy now” button and completing the immediately subsequent payment process. The buyer can also accept offers for multiple items by placing the items in the shopping cart (if available) and completing the immediately subsequent payment process.

dd) Fixed price items “Buy It Now” as a guest

ee) Conclusion of contract in auction format

ff) Early termination, withdrawal of a bid, item deletion by eBay

If the seller terminates the offer prematurely, a contract is concluded between the seller and the highest bidder, unless the seller was entitled to withdraw the offer and delete the existing bids. He is only entitled to do this in the following cases:

In certain categories, the seller can add a price suggestion function to his offer. The Price Suggestion feature allows buyers and sellers to negotiate the price of an item. The buyer's price suggestions are valid for 48 hours. Price suggestions are binding like any other offer. If the price proposal is accepted, the offer is terminated and the contract is concluded.

If the price proposal is rejected, no contract is concluded. The seller can inform the buyer of the reason for his decision.

If the seller responds to a price proposal with a counterproposal, no contract is concluded. If the potential buyer does not respond to the counteroffer within a reasonable period of time, the seller's counteroffer loses its legal effect.

Once the set offer period has expired, any price proposal that has not been accepted by the seller will also expire.

hh) shopping cart function

When using the shopping cart function, the buyer must press the “Add to cart” button on the respective item page. He will then be redirected to a subpage that displays the contents of the shopping cart. Items can be removed from the shopping cart by clicking the “Remove” button or saved for a later purchase by clicking the “Save for later” button. 5. Information on the used oil regulations

Used oil must be disposed of properly; packaging does not belong in household waste. Used oil can be returned to us depending on the quantity purchased (Fabian Buchler, Elsterweg 8, 03130 Spremberg). The same applies to oil filters and oil-containing waste that regularly arises when changing the oil. Sending is not possible because used oil falls under the Dangerous Goods Regulation.

6. Information about the Battery Act (BattG)

You can return old batteries that we have or have had in our range as new batteries free of charge to the address stated in the legal notice.

The symbols shown on the batteries have the following meaning:

The symbol of the crossed out garbage can means that the battery must not be disposed of with household waste.
Pb = battery contains more than 0.004 percent lead by mass Cd = battery contains more than 0.002 percent cadmium by mass Hg = battery contains more than 0.0005 percent mercury by mass.

The deposit is not included in the purchase price and is shown on the item next to the final price.

If you return a used vehicle battery to us that we have or have had in our range as a new battery in accordance with Section 9 BattG, we are obliged, within the framework of the legal regulations, to take it back free of charge and to refund the deposit amount.

Insofar as we comply with Section 10 Para. 1 sentence 3 BattG have issued a deposit stamp, the reimbursement of the deposit when the used vehicle battery is returned depends on the return of the deposit stamp.

Returning the used battery by post is not permitted due to the Dangerous Goods Ordinance.

Alternatively, used vehicle batteries can also be handed in free of charge to recycling centers. The deposit we charge will not be refunded by the public waste and recycling centers. However, you have the option of having the return of the used vehicle battery acknowledged on the deposit stamp. You will receive the battery deposit back from us upon presentation of the receipted deposit stamp.

7. Information about ElektroG

According to the Electrical Act (ElektroG), manufacturers are obliged to take back old electrical and electronic devices free of charge. You can hand these in free of charge to your municipal waste disposal company at the designated collection points. Your local waste disposal company can help you. Further information on ElektroG can be found at the Federal Ministry for the Environment, Nature Conservation and Nuclear Safety (www.bmu.de).

8. Data protection

a) The applicable data protection regulations and other legal regulations are complied with when collecting, storing, changing, transmitting, blocking, deleting and using personal data.
