2. Conclusion of contract, contract text, prices, codes of conduct
a) The conclusion of the contract is based on § 6 of the terms and conditions of the Internet platform eBay, which provides for the following variants of the conclusion of the contract:
aa) Auction or fixed price format also with variant minimum price
If a seller uses the eBay services to post an item in an auction or fixed-price format, he is making a binding offer to conclude a contract for this item. He determines a start or Fixed price and a period within which the offer can be accepted (offer period). If the buyer sets a minimum price for the campaign format, the offer is subject to the condition precedent that the minimum price is reached.
bb) Auction format with buy-it-now function
The seller can also provide offers in the auction format with a buy-it-now function. This can be exercised by a buyer as long as no bid has been placed on the item or a reserve price has not yet been reached.
cc) Fixed price item "Buy it now"
In the case of fixed-price items, the buyer accepts the offer by clicking on the "Buy It Now" button and then confirming it. In the case of fixed-price items for which the seller has selected the “immediate payment” option, the buyer accepts the offer by clicking on the “buy it now” button and completing the immediately subsequent payment process. The buyer can also accept offers for several items by placing the items in the shopping cart (if available) and completing the immediately subsequent payment process.
dd) Fixed-price items “Buy It Now” as a guest
Fixed-price items can also be ordered as a "guest" without an eBay account. The purchase contract is concluded here by pressing the "Buy it now" button and the "Order as a guest" button after going through the ordering process by pressing the "Buy and pay" button.
ee) Conclusion of contract for auction format
In auctions, the buyer accepts the offer by placing a bid. Acceptance is subject to the condition precedent that the buyer is the highest bidder at the end of the bidding period. A bid expires if another buyer makes a higher bid during the offer period.
ff) Premature termination, withdrawal of a bid, item deletion by eBay
If the seller terminates the offer prematurely, a contract is formed between the seller and the highest bidder, unless the seller was entitled to withdraw the offer and cancel the existing bids. He is only entitled to do this in the following cases:
The seller made a mistake when entering the offer, e.g
Material errors in the description of the item or errors in the indication of the starting or reserve price.
It is impossible for the seller to transfer ownership of the item to the buyer through no fault of his own, e.g. the item was destroyed or damaged through no fault of his own, the item was stolen or the item cannot be transferred due to a legal prohibition or a lack of title.
Buyers can only withdraw bids if there is a legitimate reason to do so. This is possible if
the buyer accidentally entered an incorrect bid amount; or
the description of an item has changed significantly after bidding.
After a justified bid withdrawal, no contract is formed between the user, who is again the highest bidder after the end of the auction due to the bid withdrawal, and the seller.
If an item is deleted from eBay before the end of the offer period, no effective contract is formed between the buyer and seller.
ff) Price suggestion function
In certain categories, the seller can provide his offer with a price suggestion function. The Best Offer feature allows buyers and sellers to negotiate the price of an item. Price proposals by the buyer are valid for 48 hours. Price proposals are binding like any other offer. If the price proposal is accepted, the offer is terminated and the contract is concluded.
If the price proposal is rejected, no contract is concluded. The seller can inform the buyer of the reason for his decision.
If the seller responds to a price proposal with a counter-proposal, no contract is formed. If the potential buyer does not respond to the counter-offer within a reasonable time, the seller's counter-offer loses its legal effect.
At the end of the set offer period, a price proposal that has not been accepted by the seller expires.
hh) shopping cart function
With the shopping cart function, the buyer must press the "Add to shopping cart" button on the respective article page. He is then forwarded to a subpage that displays the contents of the shopping cart. Articles can be removed from the shopping cart again by pressing the “Remove” button or saved for a later purchase by pressing the “Save for later” button. If the buyer wants to buy the products in the shopping cart, he must press the "Continue to checkout" button. Then he must register or open a customer account on eBay. In the following, the delivery address must be specified/confirmed, and the shipping and payment methods selected. A page of the order overview then follows, on which the details of the buyer (name, delivery address, payment and shipping method), the selected items as well as the costs and their composition are listed. Here the buyer can check his entries again and identify errors. To correct input errors, the respective "Change" button can be clicked and the data or selection can be corrected using the usual keyboard and mouse functions in the corresponding input fields. By clicking the "Buy and pay" button, the ordering process is ended and the contract is concluded.
b) The text of the contract (eBay item description) is held in German. You can find the essential characteristics of the goods or services in the eBay item description. In addition, you have the option of viewing and printing out your order at any time in your member area on eBay for up to 60 days after logging in with the user data sent to you. In addition, the text of the contract is saved as an eBay website for up to 90 days after the contract has been concluded and can be viewed by you at www.ebay.de and by entering the respective item number. We also point out that the text of the contract is not saved by the seller. The option of printing and saving is also provided by the respective internet browser.
Input errors can be corrected as part of the process of concluding the contract on the eBay internet platform. Irrespective of this, you can navigate back and forth in the ordering process by using the forward and back button of the respective internet browser. The ordering process can be canceled at any time by closing the Internet browser used.

3. 2. a) of these terms and conditions, a contract has been concluded, the goods are in stock.
b) The goods are paid for in advance. The payment options are listed in the respective product description. If cash on delivery is also offered, it is pointed out that a cash on delivery fee will be charged by the shipping company. The amount of the corresponding fee is listed under the heading "Shipping and payment methods" in the respective offer.
c) For information on the delivery time, please refer to the "Shipping and payment methods" section of the offer in the respective offer.

4. Warranty and Customer Service
a) The statutory provisions of the German Civil Code apply.
b) The statutory warranty period is reduced to one year as part of the purchase of consumer goods for used items and to entrepreneurs when selling new items. If used goods are sold to entrepreneurs, the statutory warranty is excluded. The respective item condition - new or used - can be found in the item description.
The aforementioned disclaimer does not apply to
- Claims for damages for damage to life, limb or health that are based on an intentional or negligent breach of duty by the seller or an intentional or negligent breach of duty by a legal representative or vicarious agent of the seller,
- other damages based on an intentional or grossly negligent breach of duty by the seller or on an intentional or grossly negligent breach of duty by a legal representative or vicarious agent of the seller,
- Other damages based on a culpable breach of essential contractual obligations, i.e. obligations whose fulfillment is essential for the proper execution of the contract and on whose observance the contractual partner may regularly rely. 5. Information on the Waste Oil Ordinance
Waste oil must be disposed of properly, packaging does not belong in household waste. Used oil can be returned to us according to the quantity purchased (Fabian Buchler, Elsterweg 8, 03130 Spremberg). The same applies to oil filters and oil-containing waste that regularly occurs when changing the oil. Sending not possible because waste oil falls under the Dangerous Goods Ordinance.
6. Information on the Battery Act (BattG)
You can return old batteries that we have or have had as new batteries in our range free of charge to the address given in the imprint.
The symbols shown on the batteries have the following meaning:
The symbol of the crossed-out wheeled bin means that the battery must not be disposed of with household waste.
Pb = battery contains more than 0.004% by mass of lead Cd = battery contains more than 0.002% by mass of cadmium Hg = battery contains more than 0.0005% by mass of mercury.
The deposit is not included in the purchase price and is shown next to the final price on the item.
If you return an old vehicle battery to us, which we carry or have carried as a new battery in our range in accordance with § 9 BattG, we are obliged within the framework of the statutory provisions to take it back free of charge and refund the deposit amount.
As far as we according to § 10 para. 1 sentence 3 BattG have issued a deposit token, the reimbursement of the deposit when returning the old vehicle battery depends on the return of the token.

Returning the old battery by post is not permitted due to the dangerous goods ordinance.
Alternatively, used vehicle batteries can also be handed in free of charge at recycling centers. The deposit we collect will not be refunded by the public recycling centers. However, you have the option there of having the return of the old vehicle battery acknowledged on the token. You will receive the battery deposit back from us upon presentation of the receipted deposit label.
7. Information on the ElektroG
According to the Electrical and Electronic Equipment Act (ElektroG), manufacturers are obliged to take back old electrical and electronic equipment free of charge. You can hand them in free of charge to your municipal waste disposal company at the designated collection points. Your local waste disposal company can help you. Further information on the ElektroG can be found at the Federal Ministry for the Environment, Nature Conservation and Nuclear Safety (www.bmu.de).
8. Data protection
a) The applicable data protection regulations and other legal regulations are observed when collecting, storing, changing, transmitting, blocking, deleting and using personal data. Personal data is passed on to third parties exclusively to the service partners involved in the execution of the contract, e.g. B. shipping companies, banks, insofar as this is necessary for the execution of the contract. By concluding the contract, the customer agrees to the collection, processing and use of personal data in accordance with the aforementioned information.
b) The customer has the right to receive information about the data stored about his person free of charge. To do this, he can contact the address given in the imprint.
c) If stored personal data is incorrect, the data will be corrected upon notification by the customer.
d) The customer can revoke his consent to the storage of personal data at any time with effect for the future. In the event of a revocation in this regard, the personal data stored on the customer will be deleted, unless the relevant data is still required to fulfill the obligations arising from the concluded contractual relationship or legal regulations prevent deletion. In this case, the data concerned will be blocked instead of being deleted.
