Conclusion of the contract (extract from Ebay Terms):

Buy It Now item: The contract is concluded when a member of the "Buy" button clicks and confirms the operation. Auctions: The bidder accepts the offer by placing a bid on the bidding function. The bid expires if another bidder submits a higher bid during the offer period. At the end of the auction or upon early termination of the offer by the seller comes between providers and highest bidder, a contract for the purchase of the item, unless the seller was legally entitled to withdraw the offer and withdraw the present bids. After a justified bid withdrawal is between the member who, due to the bid withdrawal is High bidder after the auction and the seller no contract. Professional and High bidder may agree that a contract is concluded.
